Albion in the Community Schools’ Competition: terms and conditions

These competition terms and conditions, together with any specific rules or conditions explained or notified by Albion in the Community (AITC) as relevant to this competition (as displayed on: www.albioninthecommunity.org.uk or otherwise) a competition notice) apply to any school completing the relevant action required to be entered into the Albion in the Community ‘Win a PE lesson’ (the competition).

By entering the competition the school agrees to be bound by these competition terms and conditions, AITC’s Privacy Policy and, where applicable, AITC’s online terms and conditions (each of which can be found at: www.albioninthecommunity.org.uk).  Any school which does not agree to comply with the terms set out therein should not enter the competition.

A copy of these competition terms and conditions and/or AITC’s Privacy Policy can be provided upon written request, enclosing a stamped addressed envelope. 

1. Introduction

1.1 This competition is organised by AITC whose address is at American Express Community Stadium, Village Way, Brighton, BN1 9BL.

1.2 AITC reserves the right to cancel or amend the competition or these competition terms and conditions and to cancel or refuse any school’s entry at any time without prior notice.  Any such changes will be posted on AITC’s website: albioninthecommunity.org.uk.

2. Eligibility

2.1 Entrants to the competition must be primary schools located in Sussex and, for the avoidance of doubt includes primary, infant and junior schools.

2.2 For the avoidance of doubt, it also includes those schools that currently work with AITC, as well as those that do not.

2.3 The eligibility of any school is at the sole discretion of AITC. If ineligible, schools will not be entitled to receive a prize (as defined below), any prize awarded may be revoked.

3. Entries

3.1 Entries must be submitted between the opening and closing dates and times (as further detailed in Condition 3.2 below) or will be deemed to be invalid. All entries must be submitted in accordance with the instructions and/or requirements (including method of entry) set out in these terms and conditions and in any competition

3.2 To be entered into the competition, schools must follow the entry procedure set out in Conditions 3.3, 3.4 and 3.5. Entries shall only be qualifying entries if received between and including 9 am on 19 September until 2017 and including 4.59pm on 13 October 2017.

3.3 Any school that wishes to enter must submit a photograph (a JPEG image at least 1MB in size) that best illustrates a class’ support for the Seagulls and what Brighton & Hove Albion FC (BHAFC) means to their pupils (the photograph). Entries must be submitted via email to: schools@albioninthecommunity.org.uk.

3.4 All entries must be endorsed by the head teacher of the school and sent by an employee of the school and the email message body should include: a contact name, contact position, contact email address, class name and year group (that would be eligible to receive a prize), full postal address for the school and school twitter handle (if the school has one).

3.5 By entering the competition the school warrants and agrees that it has: (i) explained to all pupils (and any other person) appearing in the photograph (each a participant), (and, if the participant is under 16, to his or her parent) that the photograph will be shared with and used by the AITC, BHAFC and its or their licensees, for the purposes set out in clause 3.9 below, and that the participant may be required to take part in promotional activity under clause 3.8 below; and (ii) obtained verifiable and informed consent from each participant (or his/her parent if the participant is under 16) to use the participant’s personal data for the purposes set out in clause 3.8 and 3.9, sufficient to enable AITC, BHAFC and their licensees to comply with their obligations under the Data Protection Act 1998 and any other applicable legislation.

3.6 Lost, delayed or incomplete entries will not be accepted and AITC takes no responsibility for entries that are lost, delayed or not received for any reason, and proof of despatch will not be proof of receipt.

3.7 By entering the competition, the school warrants and agrees that the photograph and the information in its entry: (i) constitutes information that is true, current and complete; (ii) is not obscene, disparaging or critical of any person, offensive, likely to infringe the rights of any third party or otherwise unlawful; and (iii) is not critical of AITC and BHAFC (to be determined by AITC in its sole and absolute discretion).  AITC reserves the right to disqualify from the competition any entries/photographs which contravene, or are found to contravene, any of the criteria set out in this condition 3.7.

3.8 The school agrees that if it is a prize-winner (as defined below) or the overall prize-winner it (and all participants) will take part in any promotional activity reasonably requested by AITC. By entering the competition the school agrees to: (i) the school’s name and local authority / county being supplied in accordance with Condition 3.10; and (ii) the use of the school’s name, logo, mark, image, entry, photograph and any other details and/or materials submitted as part of the competition, both in connection with the competition (including, but not limited to, announcing the results of the competition) and for any other promotional purpose AITC may deem appropriate.

3.9 Without prejudice to the generality of Condition 3.8, the school hereby grants (on behalf of itself and all participants) a perpetual, irrevocable and royalty-free licence to AITC, BHAFC, and its or their licensees to use all content contained in their entry (including the photograph) in any way, internally and externally, and in any media as AITC and its licensees may deem appropriate, in any territory throughout the world, including without limitation to use the photograph on AITC and BHAFC websites, post the photograph on social media channels and use the photograph in future AITC and BHAFC promotions.

3.10 The names of all prize-winners will be made available following receipt of an appropriately worded letter addressed to ‘Albion in the Community Schools Competition’ sent to AITC using the address given above, enclosing a stamped addressed envelope. AITC reserves the right not to respond to such requests if received more than forty-five (45) days after the closing date.

3.11 A maximum of one entry per class, per school will be entered into the prize draw. Automated, bulk or third-party entries will not be valid.

4. Choosing the prize-winners

4.1 Two schools shall be chosen as the winners of the competition (the prize winners) from all valid entries that AITC (at its complete discretion) deems to qualify for entry into the competition. The prize-winners shall be chosen across two stages: (1) AITC will shortlist a minimum of 10 photographs and (2) A judging panel including representatives from AITC and BHAFC (the judging panel) will agree the two best entries, including an overall prize winner.

4.2 The judging panel is specially looking for photographs that demonstrate how the class use BHAFC to:

  • Get active ‘on the pitch’ and develop healthier lifestyles.
  • Develop and learn ‘off the pitch’ in other curriculum subjects; and

4.3 The one overall prize-winner and one runner up prize-winner are collectively referred to in these terms and conditions as prize-winners, each being a prize-winner.

5. Prizes

5.1 One overall prize winner shall receive the following:

5.1.2 An invitation for one class (maximum 32 pupils) from the school in participate in a Physical Education (PE) lesson delivered by one representative of each of the BHAFC Premier League squad and BHAWFC FA Women’s Super League 2 squad (supported by a qualified AITC community coach) at the overall prize winner’s school site, on such date as shall be notified to the overall prize-winner in advance by AITC during the 2017/18 academic year.

5.2 One runner-up prize-winner shall receive the following:

5.2.1 One 2017/18 BHAFC first team shirt signed by playing staff of BHAFC first team.

5.3 The prizes received by the winner and the runner-up prize-winner are collectively referred to in these terms and conditions as prizes, each being a prize.

5.4 The prizes are subject to availability and AITC reserves the right to substitute a prize of equal or greater value.  There is no monetary equivalent or cash alternative to any prize. The prizes are non-transferable.

5.5 Unless otherwise expressly stated herein, in a competition notice or otherwise expressly agreed or notified by AITC in advance and in writing, all taxes, insurances, transfers, spending money and other expenses (including accommodation, travel, meals, personal expenses, upgrades, etc. if applicable) that are connected with any prize are the sole responsibility of the prize-winner and are not included in that prize.

5.6 Should any doubt arise as to an entrant’s eligibility, AITC reserves the right to withhold a prize until such proof of eligibility and identity has been confirmed or if such proof is not produced on request or to disqualify the entrant from the competition.

5.7 Each prize-winner will be contacted by AITC by email. AITC will attempt to contact each prize-winner three times. In the event that a selected prize-winner does not respond to AITC within three days of the first email, another prize-winner will be selected at random. Only the prize-winners will be notified.

5.8 A prize-winner will forfeit the right to a prize, without compensation or recourse, if the relevant school does not agree to be bound by these terms and conditions and/or does not meet eligibility criteria.

6. General

6.1 Liability.  AITC cannot accept any liability (other than for death or personal injury or other liabilities that cannot, as a matter of law, be excluded) for any damage, loss, costs, expenses or disappointment, whether direct or indirect, caused to or suffered by entrants in connection with the competition or as a result of any prize-winner accepting or making use of a prize.  AITC will not be liable if any prize is unable to be offered.

6.2 Law.  These competition terms and conditions and any non-contractual obligations connected to them shall be governed by, and construed in accordance with, the laws of England and Wales and the English courts shall have exclusive jurisdiction to settle any dispute which may arise under or in connection with them.

6.3 Severance.  If any provision of these terms is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these terms, which shall remain in full force and effect.
